There was a cartel agreement between ATI and NVIDIA?

Class action lawsuit filed against NVIDIA and ATI (now AMD). The lawsuit alleges that the companies concerned colluded about five years ago to fix prices. Specifically, the case file contains an e-mail that suggests that price support agreements were common in the graphics card market.

In other words, NVIDIA and ATI may have coordinated their actions, creating the appearance of competition – at secret meetings, their representatives negotiated price levels, release dates for new products, and other steps. This “pseudo-competition” allowed, acting as a single monopolist, to increase the level of sales and income.

The illustrations show how the behavior of NVIDIA and ATI has changed over time. The top graph shows the difference in price between comparable graphics card models, the bottom graph shows the difference between the release dates of new models. The first section on the graphs corresponds to the period “before collusion” (Pre-conspiracy), the second – “during the collusion” (Conspiracy). The third, very short period, begins at the moment when the companies received a subpoena (Post-DOJ Subpoena).

As the saying goes, one picture is worth a thousand words.

In total, 51 parties have filed claims, which are now consolidated into one. In addition, as it turned out, cartel behavior took place not only in the graphics market, but also in the market for DRAM, flat panels and cathode ray tubes.
